Real
Estate, Environmental & Land Use
Leahy & DeSmet, LLC is
able to assist its clients with real estate, land use and
environmental law matters. We have broad experience in land
use litigation, and we can advise clients on matters
involving covenants, rights-of way, easements, permitting
and bonding issues, construction
contracts and disputes.
For over 20 years Ms. Leahy-Fucheck
has handled complex real estate matters in the
Maryland
State and Federal District
Courts. As Chief Counsel to Maryland Governor Glendening,
she negotiated key contracts and projects for the State,
including the State’s purchase of Chapman’s Landing and
Deep
Creek Lake.
She also assisted in formulating and implementing the
Governor’s Smart Growth Initiative, and has lectured and
published on the subject. As an Associate County Attorney
and lead counsel to the
Prince George’s County Department of
Environmental Resources, Ms. Leahy-Fucheck tried, briefed
and argued numerous cases involving land use and zoning,
contract disputes, storm water management, solid waste
management, nuisance, and other environmental issues. Ms.
Leahy-Fucheck successfully challenged a thirty-year state
law precedent on vesting of development rights in
Prince George’s County v. Sunrise Dev., Ltd.,
330 Md. 297; 623 A.2d 1296 (1993).
In addition to his intellectual property practice, Mr. DeSmet
regularly handles construction and technology matters as a result of
his direct experience in those fields prior to becoming an attorney.
For example, from 1999 to 2003 Steven was the Project Manager
responsible for implementation of the Technology in Maryland Schools
Program (TIMS) in Anne Arundel County as well as several schools in
Howard County. |
